Terms of Service

Effective November 5, 2026

These terms are an agreement between Seamint LLC, doing business as Bistellar ("Bistellar", "we", "us"), and the company or organization that uses Bistellar ("Customer", "you"). They cover the Bistellar app at app.bistellar.ai, the API and MCP server, and the website at bistellar.ai (the "Services"). If you accept these terms on behalf of a company, you confirm you're authorized to do so. If Customer has a separate signed agreement with us, that agreement takes precedence.

1. Access

Bistellar is invite-only. We create a workspace for each Customer, and the workspace's owners decide who else may join. You're responsible for the people you invite, for keeping API keys secret, and for everything done under your workspace's accounts and keys. Tell us promptly at hello@bistellar.ai if you suspect unauthorized access.

2. Your content

You keep all rights to what you put into Bistellar (ad copy, scripts, voice descriptions) and, as between you and us, to what Bistellar generates for you (audio takes and designed voices). You give us permission to store, process and transmit that content only as needed to provide the Services to you. You confirm you have the rights needed for the content you submit.

3. Acceptable use

You agree not to use the Services to:

  • imitate a real person's voice or identity without their permission, or present generated audio as a real person's statement;
  • make advertising that is false, misleading or unlawful, or that breaks the rules of the platform where it runs;
  • infringe anyone's intellectual property, privacy or publicity rights;
  • create content that is hateful, harassing, sexually explicit involving minors, or otherwise illegal;
  • disrupt, overload or try to break the security of the Services, or access them other than through the app, API or MCP; or
  • resell the Services, or use them to build a competing product.

We may suspend access that breaks these rules or puts the Services or other customers at risk.

4. AI-generated output

Bistellar uses AI models, including Google's Gemini models. Output can be unexpected, inaccurate or different each time, and similar output may be generated for other customers. You're responsible for reviewing output before you use it, and for making sure your ads meet the laws and platform rules that apply to them, including any rules on disclosing AI-generated content.

5. Fees

Paid plans and credits are described in your order or plan. During the private preview, access may be provided free of charge or on terms we agree with you. We'll give you notice before charging for anything that is currently free.

6. Privacy

Our Privacy Policy explains how we handle personal information.

7. Changes and availability

The Services are in active development. We may add, change or remove features, and we may update these terms; if a change is significant, we'll tell workspace owners in advance. We aim for high availability but don't guarantee the Services will be uninterrupted.

8. Termination

You can stop using the Services at any time and ask us to delete your workspace. We may suspend or end access if you materially breach these terms. After termination you can ask us to export your content for 30 days, after which we may delete it.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE EXTENT THE LAW ALLOWS, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUE. OUR TOTAL LIABILITY ARISING FROM THE SERVICES IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND US$100.

11. Indemnity

You'll defend and indemnify us against third-party claims arising from your content, your ads, or your use of the Services in breach of these terms.

12. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Wyoming, and both parties consent to their jurisdiction.
